Thibaut added a 3.5% tariff surcharge to new orders starting May 1, 2025. The U.S. Supreme Court later struck down the tariffs behind it. So what happens to the money buyers already paid?

Emery | Reddy, PC is investigating potential claims on behalf of buyers who paid Thibaut‘s tariff surcharge. Thibaut is a wallpaper, fabric, and furniture company founded in New York in 1886. It is now based in Union, New Jersey.

How Thibaut’s Tariff Surcharge Worked

On April 8, 2025, Thibaut sent customers a letter signed by CEO Rick Kilmer. The letter announced “a flat rate surcharge of 3.5%” on all new orders received on or after May 1, 2025. It said the surcharge applied to products and parts sourced from Thibaut and its brands. The letter did not give an end date.

The surcharge may have covered products from all of Thibaut’s brands:

  • Thibaut
  • Anna French
  • Coraggio
  • Rosemary Hallgarten
  • Thibaut Fine Furniture
  • Thibaut AREAS (rugs)

Products include wallpaper and wallcoverings (grasscloth, murals and performance vinyl), upholstery and drapery fabric, indoor and outdoor fabric, tapes and trims, area rugs and furniture.

Why the Supreme Court Ruling Matters for This Surcharge

On February 20, 2026, the U.S. Supreme Court ruled 6-3 that the International Emergency Economic Powers Act (IEEPA) did not allow the tariffs imposed beginning in 2025. IEEPA is a 1977 law that gives the president certain powers during a national emergency. The tariffs officially ended on February 24, 2026.

That raises an open question. Companies that paid those tariffs may be able to seek refunds from the federal government. If a company gets money back for tariffs it passed on to buyers as a surcharge, what happens to the surcharge buyers already paid? Emery | Reddy is investigating whether buyers may be entitled to a share of any recovery.

Who May Qualify

Trade buyers. These buyers paid the surcharge directly to Thibaut. They include:

  • Interior designers and decorators with Thibaut trade accounts
  • Design firms and trade showrooms
  • Contract and hospitality buyers

Homeowners and other buyers. Many people buy Thibaut products through a designer or an online retailer, such as Fabric World, DecoratorsBest, Wallpapers To Go, Fabric Guru, Designer Wallcoverings, US Wall Decor or WallcoveringsMart. Buyers who purchased Thibaut products on or after May 1, 2025, may still want to check their invoices for a tariff or surcharge line.

Retailers are named here only to show where Thibaut products are sold. This investigation does not claim that any retailer charged a surcharge.

What to Look for on Your Invoice

The exact wording on Thibaut invoices has not been confirmed. Look for a separate line near the subtotal that mentions a tariff, tariff surcharge or 3.5% fee. It may appear as a percentage or as a dollar amount added to the order. Not sure if a line qualifies? Send it in, and the Emery | Reddy team can help sort it out.

What if I can’t find my invoice?

Try these places:

  • Your email, for order confirmations

Has a lawsuit been filed against Thibaut?

Not at this time. Emery | Reddy is investigating and gathering information from buyers.

What happens to a surcharge if the tariff behind it is struck down?

Is Thibaut still charging the surcharge?

Thibaut’s April 2025 letter did not give an end date. It has not been confirmed whether the surcharge has ended.

Do I have a legal claim?

You may. Companies have a duty to charge fees honestly and to handle money tied to unlawful tariffs fairly. If you paid Thibaut’s 3.5% tariff surcharge, call Emery | Reddy at 916.995.5968or www.emeryreddy.com for a Free Case Review. No Fee Unless We Recover.
