Emery | Reddy, PC is investigating potential claims on behalf of Ashley Furniture customers nationwide who were charged a separate “tariff surcharge” line item on their receipt or invoice between June 15, 2025 and October 5, 2025.
As tariffs on imported goods took effect through 2025, Ashley Furniture began adding a tariff-related surcharge to customer purchases. On October 5, 2025, the company discontinued the itemized surcharge and folded those costs into permanent price increases instead, ranging from 3.5% on mattresses up to 12% on import dining, occasional tables, and outdoor furniture, and 10% on import bedroom furniture. “We did a surcharge originally and then we took the surcharge off and just went to a permanent price increase,” Ashley CEO Todd Wanek told trade publication Home News Now.
Why This Matters Now
On February 20, 2026, the U.S. Supreme Court ruled 6-3 that the International Emergency Economic Powers Act (IEEPA) did not authorize the tariffs the Trump administration had imposed beginning in 2025. Those tariffs officially terminated on February 24, 2026. Ashley Furniture Industries LLC is now among the companies pursuing federal government refunds for tariffs it paid under that now-invalidated authority.
That raises a real question for anyone who paid Ashley’s tariff surcharge between June 15 and October 5, 2025: if Ashley recovers money from the government for tariffs tied to that same period, what happens to the surcharge customers already paid? Emery | Reddy is investigating whether customers are entitled to a share of any recovery, and whether the surcharge itself was properly disclosed and charged in the first place.
Who May Qualify
We’re prioritizing outreach to consumers nationwide who:
- Purchased furniture directly from Ashley, online at ashleyfurniture.com or in an Ashley HomeStore, between June 15, 2025 and October 5, 2025
- Bought bedroom furniture, dining room furniture, tables, or outdoor furniture (the categories that saw the largest surcharges and price increases)
- Have a receipt or invoice showing a separate tariff-related surcharge or fee line item
Purchases made through third-party retailers or marketplaces are a lower priority for this investigation, we’re focused on purchases made directly from Ashley.
What to Look for on Your Receipt
We don’t yet have a confirmed example of exactly how Ashley’s tariff surcharge appeared on a customer receipt, the wording may vary. Look for a separate line item near the bottom of your receipt or invoice, close to the subtotal or tax lines, that references a tariff, tariff surcharge, import surcharge, or similar fee, usually shown as a percentage or a specific dollar amount added on top of the furniture price. If you’re not sure whether a line item on your receipt qualifies, send it to us and we’ll help you figure it out.
What to Do If You Think You Qualify
- Find your receipt, invoice, or order confirmation from your Ashley purchase
- Take a clear photo or save a PDF/screenshot showing the full itemized breakdown, including any surcharge line
- Note the purchase date and what you bought (bedroom, dining, table, or outdoor furniture is especially relevant)
- Submit your information to Emery | Reddy for a Free Case Review
Do You Have Legal Options?
Consumers may have legal rights when a company charges a separate fee tied to a cost that is later found to be improperly imposed, especially if that fee wasn’t clearly disclosed at the time of purchase. This is the same type of claim Emery | Reddy and co-counsel have already pursued against other major retailers over tariff-related surcharges.
