Nice North America, LLC charged tariff surcharges up to 25% on Linear, Panamax, SpeakerCraft, and Other Smart Home Brands, a quarter of the invoice, tacked on as a separate fee dealers never agreed to. Between May 2025 and February 2026, Nice North America added tariff surcharges, an extra charge billed on top of list price, of up to 25% on some of its best-known smart home and security products. By doing so, Nice North America passed these fees onto you without your consent.
Nice North America owns Linear, ELAN, Furman, Panamax, SpeakerCraft, Proficient, Mighty Mule, and HySecurity. Professional dealers and integrators who purchased products under any of these brands during that nine-month window may have paid one of these surcharges.
Nice North America is a Carlsbad, California-based smart home and security manufacturer owned by the Italian company Nice S.p.A. It began charging tariff surcharges on several of its brands starting May 1, 2025. The surcharges applied to products imported from overseas, largely manufactured in China and Vietnam, and ranged from a few percentage points to as much as 40% depending on the brand.
How the Surcharges Worked
Nice North America sells its products through a network of professional dealers, integrators, builders, and distributors, not directly to consumers. According to strata-gee.com and RestechToday, two trade publications that cover the custom-installation industry, Nice set a different surcharge rate for each of its brands between May 1, 2025 and February 20, 2026.
Why the SCOTUS Ruling Matters for This Surcharge
On February 20, 2026, the U.S. Supreme Court ruled 6-3 in Learning Resources, Inc. v. Trump and V.O.S. Selections v. United States that the tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were unlawful. Those tariffs were terminated February 24, 2026. Unlike some other companies facing similar surcharge investigations, Nice North America does not appear to have filed its own claim for a refund of the tariffs it paid — no such claim has been identified as of this writing.
That still raises a real question for dealers, integrators, and other professional buyers who paid a Nice tariff surcharge between May 1, 2025 and February 20, 2026: if the underlying tariffs were unlawful, what happens to the surcharge already passed on to buyers? Emery | Reddy, PC is investigating whether professional buyers may be entitled to recover some or all of what they paid.
Who May Qualify
We’re prioritizing outreach to professional dealers, integrators, builders, and distributors nationwide who:
Nice North America sells exclusively to professional trade customers, not retail consumers, so this investigation is focused on dealer, integrator, and distributor accounts. Purchases of 2GIG-branded products do not qualify.
What to Look for on Your Invoice
Look for a line item referencing a tariff or import surcharge, shown as a percentage of the product cost. Because Nice’s rates varied by brand and changed between May and July 2025, the surcharge percentage on an invoice depends on which brand was purchased and when. If you’re not sure whether a line item on your invoice qualifies, send it to us and we’ll help you figure it out.
What to Do If You Think You Qualify
Do You Have Legal Options?
Companies may have obligations regarding what happens to a separate, itemized fee tied to a specific government tariff if that tariff is later struck down. Professional dealers, integrators, and distributors who paid a Nice North America tariff surcharge during the qualifying window may have legal rights and remedies worth discussing with an attorney.
Contact Emery | Reddy today for a Free Case Review if you purchased qualifying Nice North America products and your invoice shows a tariff surcharge.
Who qualifies for this investigation?
Professional dealers, integrators, builders, and distributors who purchased Linear, ELAN, Furman, Panamax, SpeakerCraft, Proficient, Mighty Mule, or HySecurity products directly from Nice North America between May 1, 2025 and February 20, 2026, and whose invoice shows a tariff surcharge line item.
Does this include 2GIG purchases?
No. Nice’s own rate lists show a 0% surcharge on 2GIG products in both the May 2025 and July 2025 updates, so 2GIG purchases do not qualify.
